Terms and conditions of sale
Breez SA, based at Rue de Genève 26 in Lausanne, operates a grocery storage (sale of food and non-food products), for delivery. The present general terms and conditions of sale apply to all orders placed on the site breeze-b2b.ch. Breez SA reserves the right to adapt or modify these terms and conditions at any time. In the event of modification, the conditions of the day will prevail.
In these General Terms and Conditions of Sale, the following words and expressions shall have the following meanings:
- The terms « The Client », « you », « yours » are aimed at customers who order products on the website breeze-b2b.ch;
- The terms "Breez SA", "we", "our" refer to the Lausanne-based company Breez SA;
- The term "Products" refers to the products offered and supplied by Breez SA to the Customer;
- The term « the website » aimed to the website breez-b2b.ch.
The present General Terms and Conditions of Sale apply to all orders for Products placed by a Customer via the Website on computer, tablet, mobile, or any other medium allowing access to the ordering site. Prior to any transaction, you acknowledge that you have read these terms and conditions and expressly declare that you accept them by checking the box "I accept the General Terms and Conditions of Sale". The images and illustrations on the breez-b2b.ch website are non-contractual. Any order implies acceptance of the prices and descriptions of the Products available for sale. In all cases, the final validation of the order is proof of the completeness of said order. This validation implies signature and express acceptance of all operations carried out on the Website. Unless obvious error on the part of Breez SA, the data stored in the information system of Nature Alimentation Sàrl have evidential value as to orders placed by the Customer. The acceptance of orders for Products placed by a customer is at the sole discretion of Breez SA.
The customer is informed of the acceptance of his order by the appearance of a message on the screen of the medium from which he placed the order and by e-mail confirmation. This message confirms that the order has been taken into account by Breez SA. Minors may not place orders on our website. In case of doubt, the order manager reserves the right to refuse the order. If the order is collected from the physical shop, an identity card will be requested. It must match the name on the payment card used to pay for the order.
Until your order is validated, it can be modified or cancelled directly on the Website. Once your order has been validated, if you wish to cancel, modify or make a complaint about your order, please contact Breez SA directly by telephone. In the event of failure to modify the order, your order validated on the platform will prevail.
The prices indicated by Breez SA on its Internet Site are in CHF (Swiss francs), taxes included.
Prices are subject to change at any time except between the placing of the order and the delivery of the Product. We accept for the moment only in person or bank transfer paiement.
The prices to be paid by the Customer will be as indicated at the time of order confirmation, except for technical errors for which we cannot be held responsible. Breez SA reserves the right to cancel an order if it reasonably appears that the order is fictitious.
In the case of online orders, the prices of products shown on the Website may differ from the prices of products offered in store.
The delivery of the order will take place at the delivery address indicated by the Customer at the time of the order. Breez SA aims to supply the Customer with the Products ordered as quickly as possible from the time of order confirmation. The Customer agrees to accept delivery of the Products at the agreed place and time (plus any reasonable delay). Delivery of large orders is at the discretion of the Breez SA establishment to which the order is placed. If you are not present to receive delivery of the products ordered at the address given at the time of your order, we will not refund the price of your order. Breez SA reserves the right to refuse delivery to a street corner or the bottom of a building.
Delivery costs are from 10.- CHF plus 1.- CHF per KG until an amount of purchase of 400.- CHF or more where the delivery will be free of charge anywhere in Switzerland.
Breez SA reserves the right to modify the composition of its products according to hazards related to product supplies. In addition, Breez SA agrees to honour orders received on the Website only within the limits of available stocks of products. In the absence of availability of the Product, Breez SA undertakes to deliver the items ordered with an extended delay, if the supplier does not give news after 2 weeks, the customer may request an immediate refund. Breez SA may offer the Customer a substitute product of equivalent quality and price. The Customer will have the choice to accept the proposed substitution or to renounce to the Product.
It is the customer's responsibility to check the quantity and condition of the Products upon delivery. If he finds omissions or damage, the customer must report immediately to the deliverer or, failing that, call Breez SA which will deal with justified claims in the manner it deems appropriate. The customer has 24 hours after receipt to report a product defect either by phone or by mail to Breez SA. If a defect is reported within this period, the customer may exchange the product within 5 days.
For reasons of hygiene, no consumable goods may be returned or exchanged.
Products may be subject to promotional offers. Any special promotional offer shall be subject to these General Terms and Conditions of Sale, which shall prevail in the event of any inconsistency between the terms of the special offer and these Terms and Conditions. Breez SA reserves the right to modify the terms of special offers or to withdraw them at any time. Any order placed before the offer is withdrawn or modified will be honored at the conditions in effect at the date of the order.
Breez SA excludes all liability in the event that the non-performance of its obligations is attributable either to the unforeseeable act of a third party, or to a case of force majeure. Similarly, Breez SA shall not be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses.
The commercial and contractual relationship between Breez SA and the Customer is governed by Swiss law. The court of the registered office of Breez SA is competent to deal with any dispute directed against it. Breez SA is however entitled to bring an action against the Customer before the court of the latter's domicile or registered office.
